Terms of Service

These Terms of Service ("Terms") govern your use of specialtyhaul.com (the "Site"), operated by Specialty Haul LLC ("SpecialtyHaul", "we", "us"). By creating an account or using the Site you agree to these Terms. If you do not agree, do not use the Site.

1. What SpecialtyHaul is

SpecialtyHaul is an online directory and marketplace that helps shippers find specialized for-hire motor carriers (for example hazmat and tanker, port drayage and heavy haul) and lets shippers send quote requests to carriers. SpecialtyHaul is not a motor carrier, freight broker, freight forwarder or insurer. We do not move freight, we are not a party to any agreement between a shipper and a carrier, and we do not set, negotiate or guarantee prices, schedules, capacity or service.

2. Information about carriers

Carrier information comes from public Federal Motor Carrier Safety Administration (FMCSA) records, from carriers themselves, and from our own review. It may be incomplete, out of date or wrong. A "Verified" badge means only that the carrier showed us control of the contact email listed in its FMCSA record, or passed our manual review. It is not an endorsement, a safety rating, a guarantee of operating authority, insurance, hazmat endorsements or fitness to carry any specific freight. Shippers are solely responsible for checking a carrier's operating authority, insurance, safety record, permits and qualifications (for example on the FMCSA SAFER system) before hiring it, and for making sure the freight, especially hazardous materials and oversize or overweight loads, is moved in compliance with the law.

3. Accounts

You must be at least 18 and provide accurate information. You are responsible for your account and for keeping your password secure. Tell us promptly at info@specialtyhaul.com if you think your account has been misused. A carrier listing may only be created by a person authorized to act for that carrier. We may suspend or remove accounts, listings or content that appear inaccurate, fraudulent or in violation of these Terms.

4. Shippers

Using the Site as a shipper is free. A quote request can be sent to up to 5 carriers, is limited per day, and expires after 48 hours. A carrier sees your contact details only after it replies to your request. Any agreement is made directly between you and the carrier. Carrier quotes are offers by the carrier and are not binding on SpecialtyHaul.

5. Carriers: subscription

Carrier listings with a Verified badge, quote requests, a full profile and capacity posts require a paid Premium membership of $19.99 per month (taxes, if any, extra). Payments are processed by Stripe. Subscriptions renew automatically at the end of each monthly billing period until cancelled. You can cancel anytime from your dashboard using "Manage or cancel subscription"; the cancellation takes effect at the end of the period you already paid for, and your listing stays active until then. Fees are non-refundable except as stated in our Refund and Cancellation Policy. We may change prices with at least 30 days' notice before your next renewal; if you do not cancel, the new price applies.

6. Self-reported listings and verification

If your company cannot be matched to an FMCSA record, you may submit a self-reported listing, which we review before it appears. You must provide truthful information and any proof we request. We may reject, edit or remove any listing at our discretion. We never overwrite public FMCSA data with self-reported data.

7. Acceptable use

You agree not to: scrape, copy or harvest data or contact information from the Site by automated means; use the Site to send spam or unsolicited marketing; submit false, misleading or fraudulent information or fake quote requests; impersonate any person or company; interfere with the Site's security or operation; or use the Site for anything unlawful. Quote request and contact details may be used only to respond to that request.

Contact data may not be scraped, copied in bulk, resold or used for mass unsolicited marketing.

8. Your content

You keep ownership of content you submit (such as listing details and messages). You give us a non-exclusive, worldwide licence to host, display and use it to operate and promote the Site. You promise you have the right to submit it and that it is accurate.

9. Disclaimers

The Site and all information on it are provided "as is" and "as available" without warranties of any kind, express or implied, including accuracy, availability, merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that any shipper will receive replies or that any carrier will receive requests or business.

10. Limitation of liability

To the fullest extent permitted by law, SpecialtyHaul and its owners and affiliates are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost cargo, delays, accidents, spills, fines or damage arising from transportation arranged through or because of the Site. Our total liability for any claim relating to the Site is limited to the amount you paid us in the 12 months before the claim, or $100 if you paid nothing.

11. Indemnity

You agree to defend and hold harmless SpecialtyHaul from claims, losses and costs (including reasonable legal fees) arising from your use of the Site, your content, your freight or services, or your breach of these Terms.

12. Termination

You may stop using the Site and close your account at any time by emailing info@specialtyhaul.com. We may suspend or end your access at any time for violating these Terms or for any legal or security reason. Sections that by nature should survive termination will survive.

13. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in New York, and you consent to their jurisdiction.

14. Changes

We may update these Terms. The "Last updated" date shows the latest version. If you keep using the Site after a change, you accept the new Terms. For material changes to paid subscriptions we will email you.
